TERMS OF USE AND PRIVACY POLICY
The present Terms of Use and Privacy Policy (“Policy”) apply to all websites and applications owned by STANDART KONTROL VE TEST HİZMETLERİ A.Ş. (“STEST”), including https://stest.com.tr/, where this Policy is published or referenced (collectively referred to as the “Digital Platforms”), and cover individuals who visit these websites and use these applications (“Users”).
Information collected offline, as well as information used within the scope of the Digital Platforms and provided or obtained by third parties, is outside the scope of this Policy. Use of the Digital Platforms is subject to the unconditional acceptance of the terms and conditions of this Policy by the Users. By accessing the Digital Platforms, Users are deemed to have accepted the terms and conditions of this Policy.
Pursuant to the Law on Intellectual and Artistic Works No. 5846, the Industrial Property Law No. 6769, and other relevant legislation, all rights related to the Digital Platforms and arising from the Digital Platforms belong to STEST. In this context, partial or complete copying, modification, extraction of source code, translation into other languages, or creation of derivative works of the Digital Platforms or any element of the content is prohibited.
All intellectual and industrial property rights related to all written, visual, audio, and electronic materials published on the Digital Platforms, including trademarks, signs, and logos, belong to STEST or the relevant third parties and organizations, and these rights are protected under applicable legislation.
The inclusion of any content on the Digital Platforms or allowing Users access to such content shall not be construed as granting any license, permission, or authorization regarding such content. Without the written consent of STEST, the Digital Platforms or their content may not be copied, reproduced, processed, or used in any physical or electronic medium. Any legal liability arising from use in violation of these provisions shall belong to the User, and all legal rights of STEST are reserved.
Each User accepts, declares, and undertakes that they will not engage in any action or transaction that may infringe the rights of STEST or third parties, and that STEST holds exclusive rights regarding the use, processing, storage, disclosure, and sharing with third parties of all written, visual, and audio information accessible to all Users on the Digital Platforms.
All content on the Digital Platforms is provided solely for promotional and informational purposes. The User accepts that, before taking any action based on such information, they are obliged to obtain final and reliable information directly from STEST.
No guarantee or commitment is given regarding the accuracy or timeliness of the information published on the Digital Platforms. Such information may contain deficiencies, errors, or differences due to updates. The User accepts that STEST shall not be liable for any material or moral damages arising from actions taken based on such information.
The purpose of the announcement areas accessible within the Digital Platforms is to allow Users to make non-commercial sales and recommendation-type postings. Users who add content to or participate in these areas are deemed to have accepted in advance the rules specified in the relevant sections. In the event of violation of the rules, STEST reserves the right to initiate legal, criminal, and disciplinary proceedings against the Users who commit the violation.
Users accept, declare, and undertake that they will not use, will protect, and will not disclose to third parties, without the written consent of STEST, any information accessible within the scope of the Digital Platforms and any written, verbal, electronic, or similar data obtained, for commercial purposes or for any other reason.
Users accept that the information and content they provide to the Digital Platforms are accurate and lawful. STEST is not obliged to investigate the accuracy of information and content transmitted or uploaded by Users, nor to guarantee that such information and content are secure, accurate, or lawful.
The security of passwords and credentials related to User accounts is entirely the responsibility of the User. STEST shall not be held liable if passwords are obtained by third parties.
STEST reserves the right, at its sole discretion, to change, suspend, or terminate the content of the Digital Platforms and the services offered; and to delete registered user information and data from its systems.
Personal data obtained within the scope of the Digital Platforms are processed only for their intended purposes, transferred to third parties when necessary, and destroyed upon the expiration of the relevant retention periods, in accordance with the information notices and policies available at www.stest.com.tr/en/pdpl-policy/.
STEST may use, process, and retain information transmitted to it by Users through the Digital Platforms in accordance with the applicable legislation on the protection of personal data and relevant policy texts.
In addition, for statistical evaluation or the provision of personalized services, identity, contact, IP address, access date, and similar information may be processed. Ensuring the security of devices and connections used to access the Digital Platforms is the responsibility of the User.
The security, accuracy, and legality of information, content, visual, and audio materials provided by third parties on the Digital Platforms are entirely the responsibility of the relevant third parties. STEST does not provide any guarantee regarding third-party content and services.
Although necessary measures have been taken to ensure that the Digital Platforms are free from viruses and similar harmful software, ultimate security is the responsibility of the User. The User accepts that they are responsible for any damage that may occur to their software, hardware, or systems due to access to the Digital Platforms.
STEST does not guarantee that the services within the scope of the Digital Platforms will be uninterrupted or error-free under all circumstances. STEST shall not be liable for any losses arising from interruptions, errors, or changes that may occur on the Digital Platforms.
The Digital Platforms may include third-party services with their own terms of use. The terms of such services belong to the relevant third parties, and this Policy applies only to the Digital Platforms. STEST shall not be held liable for the use of or any damages arising from other websites linked through the Digital Platforms.
In the event of requests from official authorities or the detection of situations that may prevent the operation of the Digital Platforms or threaten their security, STEST reserves the right to investigate User information and notify the competent authorities.
In the event that Users act in violation of this Policy, STEST reserves the right to pursue all legal and factual remedies. Any disputes arising from this Policy shall be subject to Turkish Law, and the Courts and Enforcement Offices of Ankara shall have jurisdiction.
STEST reserves the right to amend, renew, or repeal the provisions of this Policy without prior notice. Amendments shall enter into force on the date they are published. This Policy has been effective as of 01.06.2021.
